Forgive Us Our Debts

A revelatory study of how Black churches turn the financial system back against predatory lenders. When American churches face financial difficulties, a disproportionately high number of Black churches reorganize under chapter 11 bankruptcy. There are no easy explanations for this distinction: not location, denomination, leadership structure, or the reasons for the loans. In Forgive Us Our Debts, legal scholar Pamela Foohey asks why, then, Black churches account for two-thirds of all congregations that file for chapter 11 bankruptcy every year. Drawing on case studies of six Black churches and one white church, and 150 interviews with church leaders, members, and attorneys, Foohey finds answers in a long history of predatory lending. Unable to negotiate with recalcitrant loan officers, Black churches turn to the legal system to force reasonable concessions from lenders to prevent the stripping of their wealth and the destruction of their communities. While the structural discrimination remains, these churches have found in the bankruptcy system a refuge and some power to fight back.

Rule of Law After Artificial Intelligence

A timely investigation of what is at stake when AI takes legal decision-making out of human hands. Artificial intelligence is proliferating in many professions, and the legal field is no exception. In The Rule of Law After Artificial Intelligence, Katie Szilagyi investigates the philosophical and practical implications of using AI in legal spaces, beginning with several fundamental questions: What is the law supposed to do, and from where does it derive its authority? Would law still achieve these aims if automated? How might automation affect the rule of laws integrity and democratic institutions operations? Blending legal philosophy, applied case studies, and insights from both critical legal scholarship and science and technology studies, Szilagyi argues that law and storytelling are deeply connected. Through creating and contesting the law, we make sense of the information around us and generate narratives about our collective world. These narratives are not static: legal precedent evolves, and legal deliberation on hard cases can help to resolve unclear or unprecedented social issues. Szilagyi demonstrates that technological innovations make the rule of law vulnerable because large language models and machine learning undermine the visioning function of legal narratives, collapsing exercises of legal interpretation into mere administration. Datafication of lawbuilt on the biased data of our cultural pastthreatens longstanding legal ideals, lessens the constraints against abuses of power by private actors, and hamstrings societys ability to reach a more egalitarian future. Szilagyi argues instead for centering narratives within the law and, in turn, rediscovering the tales the law tells us about who we are.

Reason in Law, Tenth Edition

An indispensable introduction to legal reasoning, updated for todays political and legal environment. Since it was first published nearly five decades ago, Reason in Law has become the starting point for understanding legal reasoning, a critical component of the rule of law. The editors show how judges can integrate all the elements of a case to persuasively explain their rulingsand, even more importantly, why they sometimes fail to do so. Drawing on cases old and new, Reason in Law enables readers to become sophisticated judges of judging. Now in its tenth edition, Reason in Law includes a new chapter on the increasingly contentious and politically consequential field of administrative law and addresses recent developments in the American legal landscape, including growing conservatism in the federal judiciary and the flood of lawsuits brought against the second Trump administration. It also analyzes new cases on the First Amendment rights of high schoolers, transgender civil rights, the responsibilities universities have for student safety, Donald Trumps sweeping claims of executive power, and historic Supreme Court decisions expanding the rights of gun owners and allowing states to criminalize abortion. As always, Reason in Law connects legal theory with empirical research on the American judicial system, showing how trustworthy legal reasoning helps preserve social peace and the rule of law.

Canada and the New International Law of the Sea

This is the last of three volumes dealing with the International Legal Environment (see list in back of book), included in the Collected Research Studies of the Royal Commission on the Economic Union and Development Prospects for Canada. The Third United Nations Conference on the Law of the Sea (UNCLOS 3) culminated in the adopted of the United Nations convention on the law of the sea in 1982. Since then 150 countries, including Canada, have signed this historic treaty. It affects Canada's four major ocean industries: fishing, offshore petroleum, shipping and ocean mining. As Canada contemplates ratification of this agreement, it must consider these as well as several other maritime matters, including transit management, offshore development, marine-technology development and ocean-science policy. This volume delineates the issues and their implications for Canada's future at sea, and recommends the establishment of an independent advisory body to ensure serious and comprehensive treatment of maritime concerns.

Indigenous Spiritualities and Religious Freedom

Indigenous Spiritualities and Religious Freedom investigates the complex relationship between Indigenous legal orders and Canadian law, emphasizing the richness of Indigenous spiritual practices alongside their historical and ongoing suppression by the Canadian state. It critically examines the role and limitations of the Canadian Charter of Right's section 2(a), which guarantees freedom of religion, in protecting the spiritual lives of Indigenous communities. The book highlights the holistic nature of Indigenous spiritual beliefs, which view the spiritual as immanent and closely tied to land and specific locations. The book reveals how, by contrast, the Anglo-American conception of religious freedom often separates spiritual and religious matters from civic and political concerns, and so fails to provide meaningful protection for Indigenous cultural and spiritual practices. Many essays in this collection propose alternative approaches to the relationship between Canadian law and Indigenous legal orders, particularly regarding Indigenous spiritual practices. Ultimately, Indigenous Spiritualities and Religious Freedom reveals the challenges, and perhaps the futility, of seeking significant protection for Indigenous spiritual practices within the existing framework of religious freedom.

Wise Practices

Indigenous peoples in Canada are striving for greater economic prosperity and political self-determination. Investigating specific legal, economic, and political practices, and including research from interviews with Indigenous political and business leaders, this collection seeks to provide insights grounded in lived experience. Covering such critical topics as economic justice and self-determination, and the barriers faced in pursuing each, Wise Practices sets out to understand the issues not in terms of sweeping empirical findings but through particular experiences of individuals and communities. The choice to focus on specific practices of law and governance is a conscious rejection of idealized theorizing about law and governance and represents an important step beyond the existing scholarship. This volume offers readers a broad scope of perspectives, incorporating contemporary thought on Indigenous law and legal orders, the impact of state law on Indigenous peoples, theories and practices of economic development, and grounded practices of governances. While the authors address a range of topics, each does so in a way that sheds light on how Indigenous practices of law and governance support the social and economic development of Indigenous peoples.

Miscarriages of Justice in Canada

Innocent people are regularly convicted of crimes they did not commit. A number of systemic factors have been found to contribute to wrongful convictions, including eyewitness misidentification, false confessions, informant testimony, official misconduct, and faulty forensic evidence. In Miscarriages of Justice in Canada, Kathryn M. Campbell offers an extensive overview of wrongful convictions, bringing together current sociological, criminological, and legal research, as well as current case-law examples. For the first time, information on all known and suspected cases of wrongful conviction in Canada is included and interspersed with discussions of how wrongful convictions happen, how existing remedies to rectify them are inadequate, and how those who have been victimized by these errors are rarely compensated. Campbell reveals that the causes of wrongful convictions are, in fact, avoidable, and that those in the criminal justice system must exercise greater vigilance and openness to the possibility of error if the problem of wrongful conviction is to be resolved.

Dewigged, Bothered, and Bewildered

Throughout the British colonies in the nineteenth century, judges were expected not only to administer law and justice, but also to play a significant role within the governance of their jurisdictions. British authorities were consequently concerned about judges' loyalty to the Crown, and on occasion removed or suspended those who were found politically subversive or personally difficult. Even reasonable and well balanced judges were sometimes threatened with removal. Using the career histories of judges who challenged the system, Dewigged, Bothered, and Bewildered illuminates issues of judicial tenure, accountability, and independence throughout the British Empire. John Mc. Laren closely examines cases of judges across a wide geographic spectrum, from Australia to the Caribbean, and from Canada to Sierra Leone, who faced disciplinary action. These riveting stories provide helpful insights into the tenuous position of the colonial judiciary and the precarious state of politics in a variety of British colonies.

Punishment and the History of Political Philosophy

Contemporary philosophy still lacks a satisfying theory of punishment, one that adequately addresses our basic moral concerns. Yet, as the crisis of incarceration in the United States and elsewhere shows, the need for a deeper understanding of punishments purpose has never been greater. In Punishment and the History of Political Philosophy, Arthur Shuster offers an insightful study of punishment in the works of Plato, Hobbes, Montesquieu, Beccaria, Kant, and Foucault. Through careful interpretation of their key texts, he argues that continuing tensions over retributions role in punishment reflect the shift in political philosophy from classical republicanism to modern notions of individual natural rights and the social contract. This book will be vital reading for political theorists, philosophers, criminologists, and legal scholars looking for a new perspective on the moral challenges faced by the modern criminal justice system.

Rehumanizing Law

In a popular sense, 'law' connotes the rules of a society, as well as the institutions that make and enforce those rules. Although laws are created and interpreted in legislatures and courtrooms by individuals with very specialized knowledge, the practice and making of law is closely tied to other systems of knowledge. To emphasize this often downplayed connection, Rehumanizing Law examines the law in relation to narrative, a fundamental mode of human expression. Randy D. Gordon illustrates the bridge between narrative and law by considering whether literature can prompt legislation. Using Upton Sinclair's The Jungle and Rachel Carson's Silent Spring, Gordon shows that literary works can figure in important regulatory measures. Discussing the rule of law in relation to democracy, he reads Melville's Billy Budd and analyzes the O.J. Simpson and Rodney King cases. This highly original and creative study reconnects the law to its narrative roots by showing how and why stories become laws.

Looking forward by looking back

Celebrating the 75th anniversary of the Faculty of Law at the University of Toronto, this book brings together a wealth of legal scholarship first presented at a conference in March 2025. At the time of its creation, the Faculty of Law reconceptualized legal education in Ontario and beyond. Looking Forward by Looking Back pays homage to the visions of key figures in the schools history such as founding dean Cecil Caesar Augustus Wright, Katherine Swinton, and John Willis among many other leading lights within the faculty. Embarking on a journey of exploration and reflection, the contributors to this volume look forward by looking back at the transformation charted by the school and its faculty. The contributors depict how the examined scholars consistently developed approaches to legal and social issues that were not only innovative and influential when first introduced but that continue to be insightful and generative in our evolving world. Essential reading for law professors, practitioners, and students, Looking Forward by Looking Back calls attention to the rich history of legal wisdom that emerged from the Faculty of Law and its sustained impact.

Federally Regulated Insurers in Canada

Federally Regulated Insurers in Canada is a first of its kind textbook, deconstructing and explaining the regulation in Canada of federally regulated insurers and the complex challenges it poses. Such entities comprise the vast majority of insurers in Canada. Governments regulate insurers, including their insurance products, given their very important roles and the position of power that insurers have vis-à-vis most consumers. As a result, this regulation focuses on two key objectives: protecting the financial rights and interests of insureds and, in the case of life insurance policies, beneficiaries; and contributing to public confidence in the insurance sector and the financial system as a whole. Furthermore, governments use the following two key means to pursue these objectives: prudential regulation, which incites insurers to prudently identify, control, and manage the various risks they face; and market conduct regulation, which, regarding insurance products, incites insurers to treat their customers fairly throughout the life cycle of these products. Federally Regulated Insurers in Canada initially explores the fundamentals necessary to examine these two types of regulation, including how they compare with insurance law. The textbook then examines the aims of, and rationale for, these two types of regulation. It also provides an in-depth view of two key regulators in the area, and explores how these regulators regulate and supervise insurers.

Juducial Role in a Diverse Federation

In The Judicial Role in a Diverse Federation, Robert Schertzer uses the example of the Supreme Court of Canada to examine how apex courts manage diversity and conflict in federal states. Schertzer argues that in a diverse federation where the nature of the federal system is contested the courts should facilitate negotiation between conflicting parties, rather than impose their own vision of the federal system. Drawing on a comprehensive review of the Supreme Court federalism jurisprudence between 1980 and 2010, he demonstrates that the court has increasingly adopted this approach of facilitating negotiation by acknowledging the legitimacy of different understandings of the Canadian federation. This book will be required reading both for those interested in Canadas Supreme Court and for those engaged in broader debates about the use of federalism in multinational states.

Power and Legitimacy

An interdisciplinary analysis of the ways in which symbolic acts create social norms, Power and Legitimacy is an important contribution to the growing body of scholarship on law and literature. Drawing on the theoretical insights of Judith Butler and Pierre Bourdieu, Anne Quéma demonstrates the effect of symbolic violence on the creation of social and political legitimacy. Examining modern jurisprudence theory, statutory law, and the family within the modern Gothic novel, Quéma shows how the forms and effects of political power transform as one shifts from discourse to discourse. An impressive integration of the scholarship in these three fields, Power and Legitimacy is a thought-provoking analysis of the basis of power and the law.
